Who can file a wrongful death lawsuit?

In most states, the immediate family members of the deceased, such as children, spouses, and parents may be able to file a wrongful death lawsuit against the defendant(s). If the child or children of the deceased are under the age of 18, they may require a "guardian ad item" in court to protect his or her interests.

How long do I have to file a wrongful death lawsuit?

Every state has what is called a "statute of limitation," which is a guideline for how long an individual has to file a lawsuit. In most cases the statute of limitation to file a wrongful death claim in California is 2 years from the death of the victim, but in some situations the time frame may only allow one year in which a plaintiff may file a claim. It is extremely important to file your claim within the allotted time frame, otherwise your claim may be denied.
